1. The Service
ProxiPoint is a field-sales planning web app and PWA that helps users import accounts, map territories, find nearby accounts, plan visits, log activity, manage follow-ups, estimate mileage, and generate summaries.
2. Beta Notice
ProxiPoint is currently in beta. Features may change, be limited, contain bugs, or be unavailable. We may modify, pause, or discontinue features during beta as we improve the service.
3. Eligibility and Accounts
You must be able to form a binding agreement to use ProxiPoint. You are responsible for your account credentials and for providing accurate account information. Please notify support@getproxipoint.com if you believe your account has been accessed without authorization.
4. User Data and Responsibility
You are responsible for the data you upload, import, or enter into ProxiPoint. You must have permission to upload account, customer, contact, note, and related business data.
Do not upload highly sensitive regulated data such as medical records, payment card data, government IDs, passwords, financial account numbers, or legally restricted data. ProxiPoint is not intended to store sensitive regulated information.
5. Acceptable Use
You may not:
- Use ProxiPoint unlawfully.
- Upload malicious code or harmful content.
- Attempt unauthorized access to systems, accounts, or data.
- Interfere with or disrupt the service.
- Abuse geocoding, hosting, database, or app resources.
- Reverse engineer or copy the app except as allowed by law.
- Use the service to harass, track, or surveil people.
- Upload data you do not have rights to use.
6. Location Features
Location features require user permission. ProxiPoint does not track users in the background. Nearby account, visit proximity, and mileage current-location features are optional. Users are responsible for complying with employer policies when using location or mileage features.
7. Mileage Report Disclaimer
Mileage Report is a beta estimate. It may use straight-line mileage based on saved visits and optional verified or saved start/end points. It is not guaranteed to match actual driving mileage. It is not tax, accounting, payroll, legal, or reimbursement advice. Users should verify mileage according to their employer or tax requirements.
8. Reports and Summaries
Share Summary and other reports are generated from saved user activity. Activity may include manual entries. Reports are provided for convenience and may require user review before sharing.
9. Third-Party Services
ProxiPoint may rely on third-party services such as Firebase/Google Cloud, mapping or geocoding providers, analytics, email, support, and payment processors if added. Those services may have separate terms and policies.
10. Fees and Trials
ProxiPoint may offer a 14-day free trial during beta. Paid plans may be offered, including founding or beta pricing. Pricing, trial availability, and features may change. If payments are not yet active, paid subscriptions will be handled through the payment flow presented when available.
11. Ownership
ProxiPoint owns the app, design, software, branding, and related intellectual property. Users retain ownership and responsibility for their imported and user-entered data. You grant ProxiPoint limited permission to process your data as needed to provide, secure, support, and improve the service.
12. Availability and Changes
The service may be interrupted, changed, or unavailable, especially during beta. We may update or modify features as the product develops.
13. Disclaimers
The service is provided "as is" and "as available." We do not guarantee uninterrupted service, error-free operation, exact results, complete results, or that every feature will meet your needs.
14. Limitation of Liability
To the maximum extent permitted by law, ProxiPoint will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, or substitute services related to your use of the service.
15. Termination
You may stop using ProxiPoint at any time. We may suspend or terminate access for abuse, security risk, illegal use, or violation of these Terms.
16. Changes to Terms
We may update these Terms as ProxiPoint changes. The effective date will be updated. Continued use of the service after updates means you accept the revised Terms.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
